Terms and Conditions

1. Scope of Application

These Terms and Conditions apply to all services, offers, and contracts between

Katharina Tippmann (hereinafter referred to as “Contractor”) and the client.

Deviating terms of the client shall not apply unless expressly agreed upon in writing.

2. Services

The Contractor provides services in the field of brand strategy, brand design,

marketing and sales consulting, and related creative services.

The specific scope of services shall be defined individually in a written offer or agreement.

3. Conclusion of Contract

A contract is concluded when the client accepts an offer in writing (email is sufficient)

or commissions the Contractor verbally and the Contractor confirms the assignment.

4. Fees and Payment Terms

All prices are stated in Euros (€) and exclude VAT, unless otherwise stated.

Invoices are payable within 14 days from the invoice date without deduction.

In the event of late payment, statutory default interest pursuant to Austrian law applies.

5. Advance Payment

The Contractor reserves the right to request an advance payment of up to 50% of the total project fee before commencing work.

6. Client Obligations

The client shall provide all necessary information, content, and materials required for the execution of the project in a timely manner.

Delays caused by missing or late cooperation of the client may result in adjusted timelines.

7. Copyright and Usage Rights

All concepts, designs, drafts, and final works remain the intellectual property of the Contractor until full payment has been received.

Upon full payment, the client receives a non-exclusive, non-transferable right to use the work for the agreed purpose.

Any further use, modification, or transfer to third parties requires written consent.

8. Right of Withdrawal

Clients who are entrepreneurs within the meaning of the Austrian Consumer Protection Act (KSchG) are not entitled to a right of withdrawal.

9. Liability

The Contractor is liable only for intent and gross negligence.

Liability for slight negligence is excluded, except in cases of personal injury.

Any liability for loss of profit, indirect damages, or consequential damages is excluded.

10. Warranty

The Contractor shall perform services with due professional care.

Minor deviations customary in creative work do not constitute defects.

11. Confidentiality

Both parties agree to treat all confidential information disclosed during the collaboration as strictly confidential, unless disclosure is required by law.

12. Termination

In the event of premature termination of a project by the client, the Contractor is entitled to payment for services rendered up to the termination date.

Already paid fees shall not be refunded.

13. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of Austria,

excluding its conflict of law rules.

Place of jurisdiction is Vienna, Austria.

14. Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid,

the validity of the remaining provisions shall remain unaffected.
